Terms of Service

1. Agreement to Terms

By accessing or using RCFEIntel (“the Service”), operated at rcfeintel.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

RCFEIntel provides structured data and change intelligence for California Residential Care Facilities for the Elderly (RCFEs). Our service monitors publicly available records from the California Community Care Licensing Division (CCLD) and presents them in two forms: free public facility records, and a subscription change-intelligence dashboard covering new licenses, closures, capacity changes, leadership changes, and compliance events. We also offer a free care-referral service for families (see Section 6).

3. Data Sources and Accuracy

All facility data is sourced from public records maintained by the California Community Care Licensing Division (CCLD). While we strive for accuracy and timeliness:

• We do not guarantee the completeness, accuracy, or timeliness of the data
• Data reflects what is publicly available from state records at the time of our daily collection
• Changes may occur between the state's own publication cycles that are not immediately reflected
• The Service should not be used as the sole basis for business decisions without independent verification

4. Accounts and Registration

To access the Service, you must create an account using a valid email address or Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and current information.

5. Subscription and Payment

RCFEIntel offers the following plans:

• Professional: $99 per month, billed monthly ($49 for the first month when a promotional rate is offered). You may cancel at any time; access continues through the end of the current billing period.
• Lifetime: $2,000 one-time payment for permanent access, including all future updates and features.

All payments are processed securely by Stripe. Prices are in US dollars and are subject to change with 30 days' notice to existing subscribers. Refunds are handled on a case-by-case basis; contact us within 14 days of purchase if you are unsatisfied.

6. Family Care Referral Service

RCFEIntel offers families a free service connecting them with senior-living referral advisors and partners. By using this service, you understand and agree that:

• The service is free to families. RCFEIntel may receive compensation from referral partners or facilities when a connection or placement occurs.
• The contact information and care preferences you submit may be shared with senior-living referral partners so they can contact you, as described in the consent you provide on the request form and in our Privacy Policy.
• RCFEIntel is not a care provider, placement agency, or healthcare advisor, and does not endorse, recommend, or guarantee any facility, advisor, or care outcome. Facility selection decisions are yours alone.
• We do not guarantee that an advisor will contact you, that placement will be available, or the accuracy of any information provided by referral partners.
• You may withdraw your information or opt out of partner contact at any time by emailing ryan@rcfeintel.com.

7. Acceptable Use

You agree not to:

• Resell, redistribute, or publicly republish the data obtained through the Service without prior written consent
• Use automated means (bots, scrapers) to extract data from the Service beyond normal usage
• Attempt to interfere with, compromise, or disrupt the Service
• Use the Service for any unlawful purpose
• Share account credentials with unauthorized users

8. Intellectual Property

The Service's design, code, branding, and proprietary data processing methods are owned by RCFEIntel. The underlying facility data is sourced from public records. Your subscription grants you a personal, non-transferable license to access and use the data for your internal business purposes.

9. Limitation of Liability

To the maximum extent permitted by law, RCFEIntel and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

RCFEIntel is not a consumer reporting agency as defined by the Fair Credit Reporting Act (FCRA), and the Service, including facility reports, does not constitute a “consumer report.” You may not use any information from the Service to determine any individual's eligibility for employment, credit, insurance, housing, or any other purpose covered by the FCRA. All information is compiled from public government records about licensed facilities and is provided for research purposes only.

11. Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You may cancel your account at any time by contacting us. Upon termination, your right to access the Service ceases immediately (or at the end of your billing period for voluntary cancellation).

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
